Antiqueweb Auctions is operated by the company Wermlands Auctions AB (Org no. 559539-6853). Our address is Stockgatan 3, 66732 Forshaga, SwedenIn the following terms and conditions, Wermlands Auctions AB is abbreviated to WAAB.

1. Registration

In order to take advantage of the services that WAAB offers and to be able to participate in bidding, the customer must start by registering. The customer registers by filling out the registration form. By registering, our terms and conditions of purchase are accepted and the customer undertakes to follow the instructions given. Each customer may only have one customer account for bidding. Customers who register must be of legal age (18 years old). When registering a company, it is required that the specified contact person has the authority and authority to bind the company to the terms of use, and any terms of purchase.

The Customer is responsible for all actions taken during login using the Customer's name and password. The customer is only entitled to use their own login name and password. The customer is not entitled to transfer or sell login names or passwords to third parties. The customer must also not allow third parties to use their login name or password.

After use, logging out should take place so that personal information is protected in relation to other users of the same computer. WAAB reserves the right to deny persons and companies access to www.antiquewebauctions.com in the event of attempted fraud or misuse of services provided on the website. Legal action is taken if denied access is not accepted

2 Personal data (GDPR)

All the personal data that you provide via registration is treated by us confidentially for the purpose and in accordance with the General Data Protection Regulation (GDPR) so that your customer relationship with WAAB will function in a satisfactory manner.

WAAB saves personal identity numbers/corporate identity numbers when private individuals/companies register. This information is used so that we can make checks when handing over objects to buyers and any changes of ownership of registered vehicles.

The customer agrees that WAAB may use the customer's personal data to contact and communicate important information and offers to the customer that are specifically directed to the customer's interests. If the customer wishes not to receive these messages, the customer must inform us of this in writing. The customer can demand to be removed from our register as long as it does not violate other legislation such as the Accounting Act.  

In order to give the user access to certain additional functions, so-called session cookies are used on certain parts of our website. If your browser is set to automatically refuse cookies or if you choose not to accept the use of cookies, some parts of our website will not function properly and you will not be able to take full advantage of all the features of this website.

3. Object/ Object's description and condition

All items are used and sold as is, (unless otherwise stated). WAAB does not conduct any technical or thorough review of the objects that are sold. The condition and condition of the object are based on the seller's information to WAAB.

WAAB does not offer any viewing of the objects for sale, but it is up to the buyer to assess the condition with the help of pictures, descriptions and any videos provided on the website. If you have any technical or general questions about the objects, please contact us by email or phone.

It is the seller who has full responsibility for all information about the object as well as for any defects and errors. WAAB has no responsibility for all information that has been received or not received regarding the nature of the object.

It is the buyer's responsibility to verify whether the object meets the buyer's expectations regarding condition, age, description, etc. If the item is poorly described, it is up to the buyer to be aware that there may be hidden defects or imperfections. No guarantees can be invoked against WAAB or the client. It is the buyer's responsibility to obtain the information about the object that the person considers necessary before bidding begins.

The catalogue's starting prices are stated in SEK and are based on a market-adapted valuation and should only serve as a guide for the buyer. The price at which an item is finally sold may differ substantially from the stated asking price. WAAB reserves the right to change or add to directory information. Any changes or additions will be announced at the time of the auction or stated in the lot description.

4. Right of withdrawal & Claims

As WAAB's auctions take place only digitally and remotely, private individuals have the right of withdrawal in accordance with the Distance Contracts Act (2005:59). If the customer is a Company, there is no right of withdrawal.

Customers who wish to exercise their right of withdrawal must notify WAAB within 14 days of receiving the product.

The cancelled item must be returned to WAAB within 14 days in the same condition as at the end of the auction, at the buyer's own expense.

If the item is not returned within 14 days, no refund will be made. Returned items may not be subject to ransom or cash on delivery.

Refunds for returned undamaged items will be made within 14 banking days after WAAB receives the item.

Customers who abuse the right of withdrawal, by not sticking to the bids placed or driving up the final price and then exercising the right of withdrawal, will be excluded from future bidding.

5. Bidding, buying and paying

To bid on objects, registration of bidders on WAAB is required. After the bidder has registered and logged in to their account, it is possible to place bids around the clock until the auction ends. After bidders have registered and been assigned a customer number, the customer has also agreed to the auction terms.

It is not allowed to bid on your own submitted objects via an agent or yourself with the aim of driving up the final price.

The lowest bids allowed are determined through the bidding steps in the auction. Your bid is always a maximum bid.

It is possible to place an auto bid that is not visible on the object page. The bidder's bid is always a maximum bid. The winning bid can therefore be lower than the stated maximum bid. When the auto bid is placed, the computer bids as evenly as possible up to and including this bid.

If two equal bids are placed on a lot, the first bid wins. All bids are binding regardless of whether the bid is placed manually or through the maximum bid function.

When the auction end time is less than (2) minutes, registered bids will automatically extend the bidding by (2) minutes. In some cases, the time may vary.

Buyer's commission and hammer fee will be added to the bids stated in accordance with what has been stated in the auction of the specific object.

A reserve price is the price that the seller has accepted as the selling price. The reserve price is hidden, but it is always possible to see if the monitoring price has been reached or not. When the reserve price is reached, this is shown with green text on the current bid. Sellers have the right to accept bids below and above the reserve price.

In the event of technical problems or disruptions in internet traffic, WAAB has the right to extend, cancel or postpone the auction until the problem has been rectified. Information about this will be available on the website.

WAAB disclaims any liability for damage, loss or consequential damage that may be caused to bidders and/or their clients due to technical errors, disruptions in internet traffic, etc. WAAB is also not responsible for bids not being registered.

Winning bids are always binding. WAAB will contact the highest bidder within three (3) working days at the latest via the e-mail invoice and the winner will then be sent out by e-mail. Payment terms are immediately upon receipt of the invoice.

If payment has not been registered in WAAB's account within 5 banking days from the invoice date, WAAB has the right to offer the property to another bidder.

Swedish customers can pay their invoice by bank transfer, to our plusgiro or by swish. Alternatively, log in to My Pages and pay by card or Swish. All information regarding payment can be found on the invoice or in your winner's email. Registration of payments on Plusgirot normally takes place 2-3 working days after payment.

Buyers outside Sweden can pay the invoice by bank transfer or log in to My Pages and pay by card. The IBAN and BIC code needed for bank transfer can be found on the invoice sent out in the winner's email.

If the object is to be shipped outside the EU and WAAB is the one who will take care of the shipping, an export invoice is made excluding VAT. However, VAT and customs duties may apply to countries outside the EU when the parcel is cleared through customs by the freight forwarder in the destination country.

Registered companies within the EU with a valid VAT number have the opportunity to receive a VAT-free invoice.

If the reserve price has not been reached, the seller has the right to accept the highest bids placed. If the reserve price is not reached, WAAB has the right to mediate between the Customer and the Seller to discuss an accepting bid, if a split is not accepted, the object will return for a new auction or discussion with bidder 2 on the list. WAAB will then get back to you after the auction has ended with a message to the customer either by e-mail or phone.

6. Pick-up

Collection will only take place after payment has been completed. The buyer must be able to present confirmation of completed payment and identification upon collection. Unpaid items cannot be collected.
Payment cannot be made on site at pick-up. Receipt/delivery certificate is shown on site before loading/collection. The buyer is responsible for collection and any loading. The buyer must pick up his or her lot according to the specified pick-up times stated during the respective auction or by agreement unless otherwise stated. If the object is to be picked up by an agent, it needs to be notified to us in advance by e-mail:
info@awaab.se The agent must be able to show payment confirmation and identification.

7. Buyers

The buyer is the person who has placed the highest bid when the reserve price has been reached and the auction has closed. Another person with power of attorney can represent the buyer. However, the power of attorney must be sent in written form to WAAB. It is always the buyer's responsibility to complete the purchase.

8. Seller

The seller is the person who has chosen to hire WAAB for the sales assignment. The seller can also be called a client or submitter.

9. Reservation price

Items offered for sale may have a reserve price. The reserve price is determined by the seller and is the lowest price accepted for a sale to be approved. If the reserve price is not reached, the seller must first accept the highest bid received in order for it to be accepted.

10. Estimate

Any estimate given in the description of the object is only a rough estimate of the value of the object and should not be seen as a guide in the bidding. Bidders are expected to create their own perception of value and bid accordingly.

11. Bid, highest bid

Regardless of whether the bids are placed manually or through the maximum bid function, all bids are binding.

12. Value added tax, VAT

The majority of the objects WAAB sells are second-hand and there is no VAT (unless otherwise stated). VAT is always included in the buyer's commission and the hammer fee.

13. Fees and Buyer Commission

Buyer's commission Vehicles: When purchasing a vehicle, 10% incl. VAT will be added in buyer's commission.
Buyer's commission Parts: When buying parts, 18% incl. VAT is added in buyer's commission.
Hammer fee: 75 SEK incl. VAT.

14. Artistic works

WAAB does not sell objects that are covered by (SFS 1995:1273) of the Act (1960:729) on Copyright to Literary and Artistic Works.

15. Shipping

WAAB offers freight for goods to all over the world provided that this is stated on the item's description. If no information regarding shipping is stated on the item's description, we cannot offer shipping for that item.

16. Pictures and Videos

WAAB has the right to take pictures or otherwise depict objects for publication on the web, in printed matter, advertisements and the like. All images and videos belong to WAAB and can be used for the purposes WAAB deems appropriate.

17. Export Authorisation

According to the Act (1988:950) on Cultural Heritage and the Like, a permit is required to export certain older Swedish and foreign cultural objects. In addition, cultural goods to be exported out of the EU require a specific export authorisation under Council Regulation (EEC) No 3911/92. Applications for permits are made by contacting the Swedish National Heritage Board, Box 5405, SE-114 84 Stockholm. It is the customer's obligation to apply for this permit. The permit must be presented to WAAB before collection.

18. Liability for errors

All objects are sold in the condition they are in. It is the buyer's responsibility to carefully examine and assess the condition and characteristics of the object before bidding. The description is only intended to guide the buyer in their review of the lots. If WAAB has issued a condition report at the request of the buyer regarding the general condition of an object, this information, like catalogue information, should only serve as a guide and does not relieve the buyer of the obligation to carry out a thorough examination. You as a buyer must check the item upon collection. Any remarks thereafter will not be taken into account. Faulty goods must be returned to the location designated by WAAB, at the buyer's expense, before any refund can be made.

19. Liability

WAAB's liability to the buyer is always limited to giving a reduction of the price or a maximum refund of the amount auctioned plus commission, VAT and any resale right. Therefore, WAAB is not responsible for any direct or indirect damages that the buyer may suffer.

20. Warranty

No warranty is given on purchased items.

21. Approve Items

All objects offered at WAAB's auctions are sold in the condition they are in. The objects are usually used objects in working condition. As a buyer, it is your responsibility to examine the items, which means that you must inspect and confirm the item according to its description upon pick-up. If the customer uses a freight forwarder or agent to pick up the item, it is considered an acceptance of the item. The same applies if we book freight via a freight forwarder on the customer's behalf. WAAB or the client is not responsible for any damage discovered after the object has been collected.

WAAB or the Client does not accept responsibility for any defects or defects in the objects or properties sold due to bankruptcy or other forced sale, and in such cases the Consumer Sales Act is not valid.

22. Typos and technical problems

WAAB disclaims responsibility for any typographical and factual errors in object descriptions. It is up to WAAB to choose whether to sell, disregard bids from certain bidders and decide whether the bidding should be repeated due to doubts about the last bid, technical problems, incorrect information or other reasons. WAAB reserves the right to block bidders who are registered. WAAB is not responsible for costs, damages or consequential damages that may affect bidders or clients based on what has been mentioned above, or if bids have not been registered due to, for example, computer problems, communication difficulties and the like.

23. Dispute

Any disputes shall be settled in accordance with Swedish law and at Karlstad District Court.
